TERMS OF TRADE

General
1. Definitions: - "The Company" means Frank Cooke Plumbing and Heating The Buyer" means the person, firm or company ordering or buying the goods and labour from the company. "The Goods" means the products or subject matter of the relevant order of sale. Price in £ Sterling published by the company as required by the company.
2. The company reserves the right to reject any Job. Any order received that amends these terms is subject to written acceptance by the company.
3. All warranties run from the date fitted, this date is strictly observed.
Price
4.

Prices quoted over the phone are estimated and are not to be taken as a verbal contract to compete the work. The price will be charged as per charges published.

The company will mark-up and products sold by 20% on the retail price quoted by Plumb Center or City Plumbing Letchworth.

Payment & Title
5.

The goods remain the property of the company until all due funds relating to the goods have cleared. Payment may be made by the following: cash, personal cheque, company cheque, banker's draft, cashier's cheque or electronic transfer of funds into an account nominated by the company.

The buyer agrees that the company, or its representatives may enter the buyer's premises at any reasonable time in order to recover goods originally supplied by the company for which payment is outstanding beyond any previously written, agreed credit term.

7.

Payment is due in full on completion of work. The company reserve the right to charge interest on all outstanding invoices 5% above base rate HSBC Letchworth. Stopped or bounced cheques, the company reserve the right to charge £25.00 per occasion a cheque is returned by the clearing bank.

Defective Products
7. Products fitted by the company are supplied with a six month warranty from date of fitting unless specified at time of work.
8. Defective products under clause 7 must have a valid top copy paid invoice in full. A charge £25.00 will be made for any invoice search and duplicate copy
Gas work
9. The company will dispose of all gas parts / tube that is replaced by the company.
10. The company will charge for making safe any gas supply and any reconnections.
11.

The company has no right to make safe your gas supply without The Buyer's permission. In   the event of a refusal the company will report any unsafe appliance to Transco part of British Gas.

Warranty Work
12.

The company will honour any warranty work within the hours of 09:30 Hrs to 16:00 Hrs Monday to Friday at Its earliest date available. In the event a no fault is found The Buyer will be liable to pay a minimum one hours labour and cover any time spent at the advertised rates.

Force Majeure
13.

The company reserves the right to cancel, suspend or vary the operation of contract of sale if events occur which are in the nature of force majeure including (without prejudice to the generality of the foregoing) fire, flood, storms, plant breakdown, strikes, lock outs, riot, hostilities, non-availability of material or suppliers or any other event outside the control of the company; and the company shall not be held liable for any breach of contract resulting from such an event.

Law
14. The conditions of sale shall be constructed in accordance with English Law.
